Terms of Service

1. Scope

These Terms of Service govern all agreements between Arik Wittlich, Bassener Dorfstraße 19, 28876 Oyten, Germany (hereinafter "Provider") and users of the Httrace service (hereinafter "Customer").

Deviating terms and conditions of the Customer are not recognized unless the Provider expressly agrees to their validity in writing.

2. Service Description

Httrace is a Software-as-a-Service product that provides the following:

The exact scope of services is determined by the pricing plan in effect at the time the contract is concluded, as published at httrace.com/#pricing.

3. Contract Formation and Duration

The contract is formed when the Customer registers and selects a plan, or — in the case of the free plan — when the Customer uses the service by activating an API key.

The free plan runs indefinitely and can be terminated at any time without notice. Paid plans are billed monthly and renew automatically unless cancelled before the end of the billing period.

4. Prices and Payment

Current prices are listed at httrace.com/#pricing. All prices are net of applicable taxes unless otherwise stated.

Payment is collected monthly in advance via Stripe. In the event of payment default, the Provider reserves the right to suspend access to the service.

5. Cancellation

The Customer may cancel their subscription at any time effective at the end of the current billing month by contacting founders@httrace.com. No partial refunds of payments already made will be issued.

The Provider may terminate the contract with 30 days' notice without stating reasons. Immediate termination is possible in cases of serious breach of these Terms.

The Provider targets 99% availability per year. Exceptions include scheduled maintenance and outages beyond the Provider's control (force majeure, third-party provider failures).

A legal right to a specific availability level only exists where expressly agreed in the pricing plan (e.g. Enterprise SLA).

8. Privacy and Confidentiality

The Provider processes Customer data solely for the purpose of delivering the service and in accordance with the Privacy Policy. HTTP payload data is anonymized through automatic PII filtering before leaving the Customer's server.

9. Limitation of Liability

The Provider is liable without limitation for damages arising from injury to life, body or health, and for intentional or grossly negligent breaches of duty.

Otherwise, the Provider's liability is limited to foreseeable, contract-typical damages. Liability for lost profits, indirect damages, and consequential damages is excluded to the extent permitted by law.

The Provider's total liability to the Customer is capped at the amount the Customer paid for the service in the 12 months preceding the event giving rise to the claim.

10. Changes to These Terms

The Provider reserves the right to modify these Terms with 30 days' notice. Changes will be communicated by email to the address on file. If the Customer does not object within 30 days, the new Terms are deemed accepted.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Jurisdiction is, to the extent permitted by law, Oyten, Germany.

If any provision of these Terms is or becomes invalid, the remaining provisions remain in effect.
